Key Facts
- Form I-130 + I-130A
- Spouses of citizens: no visa wait
- Spouses of residents: visa bulletin wait (F2A)
- Conditional card if married under 2 years
- Remove conditions with Form I-751
How Does a Marriage Green Card Work?
The U.S. citizen or permanent resident spouse files Form I-130 to prove the marriage is legally valid and genuine. Spouses of U.S. citizens are immediate relatives with no annual limit. Spouses of permanent residents are in the F2A category and may have to wait for a visa number.
The immigrant spouse then applies for the green card itself, either through adjustment of status (Form I-485) in the U.S. or through consular processing abroad. The petitioner also signs an Affidavit of Support (Form I-864).
Live and work in the U.S. A green card gives permanent residence and the right to work for any employer.
Work and travel while you wait. With adjustment of status you can request a work permit and advance parole.
Citizenship sooner. Spouses of U.S. citizens can usually apply for naturalization after three years.
Do I Need a Lawyer for a Marriage Green Card?
Simple cases can be filed alone, but marriage cases are denied or delayed for weak evidence, prior immigration violations, past marriages, criminal records or income below the Affidavit of Support requirement. Interviews can be separated and detailed.
We check eligibility to adjust status, prior unlawful presence and waivers, prepare a joint sponsor if needed, assemble bona fide marriage evidence and attend the interview with you.
Who Qualifies?
- A legally valid marriage to a U.S. citizen or permanent resident, recognized where it took place.
- A bona fide marriage — entered into to build a life together, not for immigration benefits.
- Prior marriages legally ended for both spouses.
- Financial support — the petitioner (or a joint sponsor) must meet at least 125% of the federal poverty guidelines on Form I-864.
- Admissibility — no unwaived bars for crimes, fraud or immigration violations.
Adjustment of Status vs. Consular Processing
Adjustment of status is for spouses already in the U.S. Spouses of U.S. citizens who entered lawfully can usually adjust even if their status expired. Spouses of permanent residents generally need to be in lawful status.
Consular processing is for spouses abroad, or in the U.S. but unable to adjust. It ends with an interview at a U.S. embassy. Spouses with unlawful presence may need an I-601A waiver before leaving.
| Question | Adjustment (I-485) | Consular processing |
|---|---|---|
| Where you wait | In the U.S. | Abroad |
| Work permit while waiting | Yes, with I-765 | No |
| Interview | USCIS field office | U.S. embassy or consulate |

- Medical exam — Form I-693 by a USCIS civil surgeon.
- Biometrics — fingerprints and photo.
- Interview — we prepare both spouses.
- Green card — a 2-year conditional card if married under two years at approval, otherwise a 10-year card.
- Form I-751 — filed jointly in the 90 days before the conditional card expires.
Marriage Cases in 2026: What to Expect
More interviews and scrutiny. USCIS has increased interviews and fraud reviews for family cases since 2025. Prepare for detailed questions and bring updated joint evidence.
Current fees. Since April 2024, Form I-130 costs $675 on paper ($625 online), Form I-485 costs $1,440, and the work permit and travel document carry separate fees when filed with the I-485. Check USCIS for the current fee schedule before filing.
Status matters. Overstays, prior removal orders or entries without inspection change which path is available.

How much does a marriage green card cost?
USCIS fees depend on the path: the I-130 plus the I-485 and optional work and travel permits for adjustment, or the I-130 plus NVC and consular fees abroad. The legal fee depends on the case history. We explain our fees clearly during your consultation, before you decide to hire us.
Marriage Green Card: Frequently Asked Questions
How long does a marriage green card take?
It varies by USCIS office and path. Many adjustment cases take one to two years, and consular cases depend on NVC and embassy backlogs. Spouses of permanent residents may also wait for a visa number.
Can I get a green card if I overstayed my visa?
If you entered lawfully and married a U.S. citizen, you can often adjust status in the U.S. despite the overstay. Entries without inspection usually require consular processing and possibly an I-601A waiver.
What is a conditional green card?
If you were married less than two years when the green card is approved, you receive a 2-year conditional card. You must file Form I-751 in the 90 days before it expires to get a 10-year card.
What if my spouse does not earn enough for the Affidavit of Support?
A joint sponsor who is a U.S. citizen or permanent resident and meets the income requirement can sign a separate Form I-864.
Can I work while my marriage green card is pending?
If you file Form I-765 with your I-485, you can work once the work permit is approved.
What happens at the marriage green card interview?
An officer reviews your documents and asks both spouses about your relationship and daily life. Some interviews are conducted separately. We prepare you and can attend with you.
